Estate Planning Malpractice

Estate planning malpractice is a common concern, and raises a number of issues:

  • Did the drafting attorney carry out the wishes of the deceased in drafting the will?
  • Did the drafting attorney properly consider the estate tax and income tax consequences of the estate plan?
  • Did the drafting attorney properly lay out all of the options to the deceased so that the best estate plan could be drafted?
  • Did the drafting attorney ensure that the will was properly executed?
  • Was life insurance placed in an insurance trust?
  • Did the estate end up in litigation as a result of the carelessness or malpractice of the drafting attorney?
  • Out of state attorneys often draft Florida wills and trusts.  These attorneys often do not know the unusual nature of some of Florida's inheritance laws, including Florida's homestead laws and Florida's elective estate laws.  Malpractice claims are often brought against such out of state attorneys.
