  • Florida Homestead Litigation.  Florida Homestead issues are litigated on several topics, including a) whether property is the protected homestead of a debtor in the face of a creditor claim, b) determining the proper owner of Florida homestead property after the death of the owner, and c) whether a residence qualifies for Florida homestead purposes for property tax benefits
  • Partition Actions.  When more than one person owns real estate and at least one owner wishes to sell the property and at least one owner does not, a Florida partition action allows the owner wishing to sell an ability to do so.
  • Real Estate Contract Lawsuits.  When a contract for the purchase and sale of real estate does not go through, sometimes the aggrieved party may have recourse against the other through a lawsuit.
  • Faulty Real Estate Closings.  In connection with a real estate closing, sometimes the settlement agent, as a result of negligence, fraud or some other reason does not handle the closing properly.  A lawsuit may offer some recourse.
  • Quite Title Actions.  When ownership of real estate is in dispute, a quiet title action can be filed to determine the proper ownership of the real estate.
